Is a foreigner with International Driving Permit (IDP) allowed to drive in China? China is not yet a contracting party of Convention on Road Traffic, therefore a foreigner with IDP merely is not permitted to drive in China, otherwise in accordance with Road Traffic Safety Law , he is subject to punishment. According to Provisions on the Application for and Use of Motor Vehicle Driving Licenses promulgated by the Ministry of Public Security, if a foreigner with IDP wants to drive in China, he shall submit an application in local vehicle administration and pass written exam in English, Russian, Japanese, French or Spanish. In September, 2011, a French guy called "Mario" drove his friend's car and crashed into Miss Zhang who was on a bicycle in Beijing. Beijing Fengtai Court ruled that the plaintiff was injured in the traffic accident; therefore, the damages shall be borne by the insurance company, Mario and the car owner (Mr. Li). The car owner shall take joint liability with Mario, because he lent his car to a person without Chinese driving license. The judgment in the first trial ruled that the insurance company shall compensate Mrs. Zhang RMB 110,000, while Mario and Mr. Li shall be jointly liable for damages of RMB 26,992.
