WTO commitments or existing regulations on examination and approval

According to Provisional Regulations on Management of Sino-foreign Equity/Contractual Joint Venture medical Institutions: 1. The establishment of a wholly foreign-owned company is forbidden; 2. Both Chinese and foreign parties are able to provide internationally advanced medical institution management experience and medical technologies and equipment or supplement the local deficiency in respect of medical service ability, medical technologies and funds; 3. The total investment shall be no less than RMB 20 million; 4. The proportion of equity or interest owned by the Chinese party shall be no less than 30%; 5. The operation period shall not exceed 20 years.

Commitments under CEPA

1. The majority of medical personnel employed by Hong Kong-Mainland joint venture hospitals or clinics can be Hong Kong permanent residents. 2. The maximum duration of the license to provide short-term medical, dental and Chinese medicine services in the Mainland is extended from 1 year to 3 years for practitioners who are legally eligible to practise in the Hong Kong Special Administrative Region. 3. Hong Kong permanent residents, who have acquired a medical degree from the university of Hong Kong, or the Chinese University of Hong Kong, and who are legally eligible to practise in Hong Kong, are allowed to sit the Mainland’s qualification examination. A “medical practitioner’s qualification certificate” of the Mainland will be issued to those who pass the examination. 4. Hong Kong permanent residents who have acquired a dental degree from the University of Hong Kong and who are legally eligible to practise in Hong Kong and have practiced for more than 1 year are allowed to sit the Mainland’s qualification examination. AA “medical (dental) practitioner’s qualification certificate” of the Mainland will be issued to those who pass the examination. 5. Hong Kong permanent residents who have acquired a medical, a dental, or a Chinese medicine higher degree from a full-time tertiary institution approved by the Education Administration Department of the Mainland State Council are allowed to acquire the “medical practitioner’s qualification certificate” of the Mainland according to the above provisions. 6. Hong Kong permanent residents who have acquired a Chinese medicine degree from the Chinese University of Hong Kong or the Hong Kong Baptist University and are legally eligible to practise in Hong Kong are allowed to sit the Mainland’s qualification examination on the condition that they have completed 1 year’s internship in a third-level Chinese medicine hospital in the Mainland and have passed the performance test; or that they have been practicing in Hong Kong for more than 1 year. A “medical (Chinese medicine) practitioner’s qualification certificate” of the Mainland will be issued to those who pass the examination. 7. Hong Kong permanent residents may apply for sitting Mainland’s medical practitioner qualification examination for clinic service, traditional Chinese medicine and stomatology.

Examination and Approval procedure

1. After being accepted by local Public Health Bureau, the application is forwarded to Guangdong public Health Department. After examination by Guangdong Public Health Department, the application is submitted to Ministry of Public Health for examination and approval; 2. The application for the establishment of traditional Chinese medicine Administration for examination and then to Ministry of Public Health for approval; 3. After the approval by Ministry of Public Health, local Foreign Trade and Economic Cooperation Bureau submits the contract and articles of association to Ministry of Commerce for examination and approval; 4. Apply to Guangdong Public Health Department for Medical Institution Practicing Permit.
