WTO commitments or existing regulations on examination and approval |
According to the Regulations on Establishing Foreign-invested Advertising Enterprises: 1. A foreign-invested advertising enterprise only refers to an equity joint venture and contractual joint venture. The establishment of wholly foreign-owned companies is not allowed; 2. The parties to joint venture shall be mainly engaged in advertisement operation; 3. It shall be able to introduce internationally advanced advertisement production technologies and equipment; 4. It shall have the ability of market investigation, advertisement planning and advertising effectiveness measurement; 5. it shall be able to train Chinese employees in respect of advertisement planning, creative idea, design, production and operation management; 6. Its registered capital shall be no less than US$0.3 million. |

Commitments under CEPA |
Hong Kong enterprise juridical person engaging in advertising services (but not necessarily as its principal business) is allowed to set up wholly-owned advertising firms in the Mainland. |

Examination and Approval procedure |
1. The Chinese party of a project or an incorporated enterprise that satisfies the conditions for Hong Kong service suppliers in CEPA submits project proposal and feasibility report to Shenzhen Administration for Industry and Commerce. After examination and consent by Shenzhen Administration for Industry and Commerce, the materials are forwarded to state Administration for Industry and Commerce for examination and approval; 2. The applicant appliers to Shenzhen Foreign Trade and Economic Cooperation Bureau for the contract and articles of association by presenting Written Opinions on Evaluation of Projects of Foreign-invested Advertising Enterprises issued by State Administration for Industry and Commerce; 3. Submit the contract and articles of association to Ministry of Commerce for examination and approval and apply for approval certificate. |
