According to Guangdong Provincial Public Security Department, Guangdong police will strength its cracking down on gambling during Spring Festival.
Organizing gambling activities is illegal in China. According to Article 303, Criminal Law of China, Whoever, for the purpose of reaping profits, assembles a crow to engage in gambling, opens a gambling house, or makes an occupation of gambling is to be sentenced to not more than three years of fixed-term imprisonment, criminal detention, or control, in addition to fine.
Guangdong Provincial Public Security Department indicated that they busted more than 35,000 gambling cases and detained over 220,000 suspects last year.
In April last year, Guangdong police launched joint-operation with its counterparts in the Philippines and detained 135 suspects in the two countries. More than 145 million yuan worth of assets, including 33.89 million yuan in cash, was involved in the case.
Interpretation of the Supreme People's Court and Supreme People's Procuratorate about Some Issues Concerning the Application of Law in Gambling Criminal Cases
Article 1 Whoever, for the purpose of making profits, is under any of the following circumstances shall fall within the scope of “gathering people to engage in gambling” as described in Article 303 of the Criminal Law:
(1) Organizing 3 persons or more to engage in gambling and having accumulatively reaped illicit gains in a sum of 5,000 yuan or more by taking a percentage from the gambling money;
(2) Organizing 3 or more persons to engage in gambling and the accumulative gambling stakes accounting for 50, 000 yuan or more;
(3) Organizing 3 or more persons to engage in gambling and the accumulative number of gamblers accounting for 20 or more; or
(4) Organizing 10 or more persons to engage in gambling abroad and from which he charges kickbacks and referral fees.
