The minimum stay for foreigners with a work permit would be cut in half and residence permits' validity would range from 180 days to five years under a draft law that's nearing final approval during the national legislative session.

The draft law regarding exit and entry administration was submitted yesterday to the National People's Congress Standing Committee, the country's top legislature, for its third reading. The law could go to a committee vote after the third reading.

The minimum stay for work-permit holders would drop from 180 days to 90 days, essentially from six months to three.

About 200,000 foreigners held work permits in China at the end of 2011, most of them company employees and teachers, according to the Ministry of Public Security.

A managing director with the Shenzhen office of a U.S.-based electronics company, who asked to remain unidentified, said a shortened minimum stay likely wouldn't affect operations — "It wouldn’t be a huge impact," he said — but could create more bureaucratic hurdles for short-term foreign workers.

The proposed law could mean that foreigners seeking work permits have to go through associated visa processes more frequently.

That would create more expenses such as visa fees, express mail fees for sending passports, and so on, potentially adding up to a few hundred U.S. dollars per application.
