Foreign expert who apply for a job in China shall observe laws and statutes of China, be healthy, and have no criminal record. In general they are divided into the categories as follows:
I. Foreign professional technical personnel or managerial personnel who are appointed to work in China for the agreements, conventions between governments or international organizations or the Sino-foreign economic and trade contracts;
II. Foreign professionals employed to work in China in the fields of education, scientific research, press, publication, culture, arts, public health and sports etc.;
III. Foreign senior professional technical personnel or managerial personnel who are employed with rank of vice general manager or above or enjoy the same rank of treatment in enterprises within the territory of China;
IV. Foreign representative's offices in China for overseas expert organizations or human resource consulting agencies that are approved by State Administration of Foreign Experts Affairs;
V. Foreign professional technical personnel or managerial personnel who have particular expertise, highly demanded in China in the fields as economy, technology, engineering, trade, finance, financial accounting, taxation, and tourism etc.;
The foreign experts in Category 2 and 3 shall have academic degree as university bachelor or above and more than 5 years of relevant working experiences (among whom language teachers shall have academic degree as university bachelor or above and no less than 2 years of relevant working experiences).
Notice: Before coming to China, foreign experts in Category II (foreign cultural and educational experts) shall be aware that the employer must have "Certificate of Authorized Qualification for Employment of Foreign Cultural and Educational Experts". Otherwise, working for employer who does not have said permit, may not only have personal rights and interests deprived, but also result in possibility of violating laws of China.
